By accessing or using NovaXplora, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use the service.

2. Eligibility

You must be at least 13 years old to create an account and use NovaXplora. By creating an account, you represent that you meet this age requirement. If we learn that a user is under 13, we will promptly terminate their account.

3. Account Registration

  • You must provide accurate and complete information when creating your account.
  • You may only create one account per person.
  • You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
  • You must accept the Privacy Policy and these Terms of Service to use NovaXplora.

4. Acceptable Use

When using NovaXplora, you agree not to:

  • Use the service for any illegal or unauthorized purpose.
  • Upload content that is illegal, harmful, threatening, abusive, or inappropriate.
  • Attempt to access other users' data or accounts without authorization.
  • Use automated tools, bots, or scrapers to collect data from the service.
  • Interfere with or disrupt the service or its infrastructure.
  • Impersonate another person or misrepresent your identity.

5. User Content

  • You retain ownership of all content you create, including trip plans, dreams, photos, comments, and other materials.
  • By uploading content to NovaXplora, you grant us a limited, non-exclusive license to host, store, and display your content to you and to users you have authorized through collaboration features.
  • You are solely responsible for the content you upload and share.
  • We reserve the right to remove any content that violates these terms or is otherwise objectionable.

6. Collaboration and Sharing

  • Content you share through collaboration features is visible to the users you invite.
  • Permission levels (viewer, editor, admin) determine what collaborators can do with shared content.
  • Collaborators may view or modify shared content according to their assigned permission level.
  • You can revoke access to shared content at any time by changing collaboration settings.

7. AI-Powered Features

NovaXplora uses artificial intelligence to provide activity suggestions, destination recommendations, and other planning assistance. These AI-generated suggestions are provided for informational purposes only and do not constitute professional travel advice. You should independently verify any recommendations before making travel decisions or bookings.

8. Third-Party Services

NovaXplora relies on third-party services, including Stadia Maps for route planning and navigation functionality. These features depend on external service availability and may be temporarily unavailable if a third-party provider experiences downtime.

  • Third-party services are subject to their own terms of service and privacy policies, which may differ from ours.
  • We are not responsible for the availability, accuracy, or content provided by third-party services.
  • By using features powered by third-party services, you agree to comply with their respective terms. You can review the Stadia Maps Terms of Service for details on the routing service.
  • Geoapify— NovaXplora uses Geoapify Places API to provide restaurant and dining discovery features. When you search for restaurants near a destination, the destination's coordinates and your search criteria are sent to Geoapify to retrieve relevant results. Geoapify's use of this data is governed by their Terms of Service.

9. Account Termination

  • You may delete your account at any time from your profile settings.
  • Deleted accounts enter a 30-day grace period, during which you may contact us to recover your account. After 30 days, your account and data are permanently deleted.
  • We reserve the right to suspend or terminate accounts that violate these Terms of Service, with or without prior notice.

10. Data and Backups

NovaXplora is a trip planning service, not a data backup or archival platform. While we follow industry-standard data management and protection practices to safeguard your content, no system can guarantee absolute protection against data loss.

  • You are solely responsible for maintaining your own backup copies of any content or data you store on NovaXplora.
  • We strongly recommend that you regularly export or save copies of important trip plans, itineraries, and other content you create.
  • To the fullest extent permitted by applicable law, we shall not be liable for any loss, alteration, corruption, or deletion of your data, including but not limited to data loss caused by system failures, security incidents, or circumstances beyond our reasonable control.

11. Disclaimers

NovaXplora is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We are not a travel agency or booking service. We do not guarantee the accuracy, completeness, or reliability of any AI-generated suggestions or user-submitted content. We are not responsible for any travel outcomes, costs, or experiences resulting from the use of this service.

12. Limitation of Liability

To the fullest extent permitted by applicable law, DeviceCortex and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or in connection with your use of NovaXplora. Our total liability for any claim arising from these terms or the service shall not exceed the amount you paid us, if any, during the twelve months preceding the claim.

13. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of material changes by posting the updated terms on this page with a revised "Last updated" date. Your continued use of NovaXplora after changes are posted constitutes your acceptance of the revised terms.

14. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising under these terms shall be resolved in the courts of competent jurisdiction.
